A three-judge panel of the U.S. Second Circuit Court of Appeals has struck down a New York state law provision requiring private property owners to post signs allowing concealed carry on property open to the public. The court also rejected the New York’s unconstitutional attempt to make all houses of worship in New York “gun-free” zones. The massive 261-page decision (pdf link) dealt with four separate First and Second Amendment challenges of New York’s post-Bruen gun control legislation. However, much of the New York law was upheld. Mississippi attorney Stephen Stamboulieh represents some of the plaintiffs. Look for an appeal.

The Second Amendment Foundation, along with three individual plaintiffs, has filed suit (here – pdf link) against the Cortland Housing Authority in Cortland, New York, because their banning the possession of handguns in the home violates the constitutional rights of residents.

The NRA has added the anti-gun liberal American Civil Liberties Union as co-counsel with Brewer, Attorneys & Counselors in an appeal before the U.S. Supreme Court, of its First Amendment case against New York’s Department of Financial Services. This has nothing to do with New York’s suit against the NRA’s corrupt leadership.

“We don’t support the NRA’s mission or its viewpoints on gun rights, and we don’t agree with their goals, strategies, or tactics,” the ACLU in a statement posted on X. “But we both know that government officials can’t punish organizations because they disapprove of their views.”

Although this situation certainly illustrates the strength of the NRA case, I don’t think we need friends like this. Of course when you are down in the sewer with Brewer, you can’t do much more damage.

The permanent Plastic Gun Ban reauthorization has been REMOVED from the National Defense Authorization Act, or NDAA, but the Undetectable Firearms Act ban still needs to expire in February and not be reauthorized.

Apparently back in 2019 the FBI issued a memo advising that state-registered medical marijuana caregivers or growers aren’t automatically disqualified from owning a firearm, but merely possessing a medical cannabis card as a patient or otherwise being an “unlawful user” does render a person ineligible. We are unaware of any constitutional article giving the federal government the authority to regulate guns or drugs.

Kopel: Why does Colorado allow law enforcement to carry the tools of mass killers, whose “one purpose” is “to kill large numbers of people quickly?” Do Colorado law enforcement officers routinely carry arms for the “one purpose” of mass killing?

NRA

Joe DeBergalis has been dismissed as Executive Director of General Operations at the NRA. DeBergalis is a friend of a friend, and has been a 2ANews list member, though I don’t think he is anymore. I lost track of him when Juno STOLE my email account and address book. Interestingly, DeBergalis does not seem to appear on any witness list for the NRA corruption trial in New York next month. But I bet he knows stuff. That’s why he was fired. However, both his replacement Andrew Arulanandam and his executive assistant Lisa Supernaugh are on the list. I reiterate: I bet he knows stuff.

Not a DGU

Generally you cannot legally shoot at a crook who is running away and not threatening anyone. There are exceptions in some places for fleeing dangerous felons, but you don’t want to be in that case either.

The Only Ones

An unidentified retired police officer in Pleasant Hill, CA, allegedly shot his wife through a door to their garage while remaining barricaded inside his home, posting odd messages on X.

Recently retired decorated Pittsburgh police detective Chunliam Nai Saechao, 40, is being held without bail after being charged with nine felony counts, including attempted murder of police officers, assault with a firearm, and injuring a spouse after a three-day standoff at his barricaded home where he allegedly shot his wife. During his time as a detective, Saechao “was a valued member of the Investigations Division where he was primarily responsible for Domestic Violence Investigations,” according to the Pittsburgh PD.

Los Angeles Police Chief Michel Moore says his Department is allowing illegal alien non-citizen DACA (Deferred Action for Childhood Arrivals) recipients who become sworn officers the ability to carry a firearm full-time.

Michigan Department of Natural Resources officer Ryan Cox, 22, has been charged with felony assault with intent to do great bodily harm less than murder and a felony firearm charge after he allegedly shot someone while off duty at a county park this past spring after a fight broke out between a member of his family and other campers.

An unidentified off-duty Suffolk County, NY officer who is also a local Board of Education member left his off-duty firearm in the bathroom at his child’s high school where he was attending a meeting Monday evening.

Department of Idiocy

An unidentified 57-year-old woman brought a concealed handgun into the room with an MRI instrument before it went off and shot herself in the butt. According to the FDA report, the patient had been screened for any metal objects and said that she wasn’t carrying anything potentially dangerous into the appointment. The report does not say where this accident happened, including the state or hospital.

Not to pick on the less fortunate, but here’s an illustration of Big Brother at work. The real problem is that one must figure out exactly WHICH bureaucrats are competent and which ones aren’t. And above all else, remember that government is not a solution.

Yes, people are that stupid. The problem is not that they shoot themselves, but that a lot of them vote, and some get elected.

Didja ever notice that the “experts” telling you to “run, hide, fight” an active killer do not follow that mantra themselves? And then they tell you to fight back with a stapler, rolled-up magazine or somesuch. I was once in a PLANNING meeting discussing how to prepare for such an event. They wanted us to PLAN to fight back with crap. Yeah. They want you dead. How many cops do you see with only a stapler in their holster? ‘Nuff said.
