Litigation
- The US Supreme Court has denied cert in the cases Maryland Shall Issue v. Moore and Gray v. Jennings, which challenged Maryland’s handgun-purchase licensing requirements and the preliminary injunction standard set in the case against Delaware’s sales ban on popular guns and magazines, but relisted two other closely watched Second Amendment cases, Snope v. Brown and Ocean State Tactical v. Rhode Island, to be considered again in today’s conference.
- The Supreme Court also distributed the Second Amendment case B&L Productions v. Newsom, for conference on Friday, Jan. 24. The case challenges California’s statutes which ban gun shows on state-owned property and includes First Amendment issues as well.
- A panel of the Third US Circuit Court of Appeals ruled 2-1 to remand the case Madison Lara v. Commissioner Pennsylvania State Police back to the District Court with instructions to enter an injunction forbidding the state police from arresting law-abiding 18-20-year-olds for openly carrying firearms during a declared state of emergency, saying “We therefore reiterate our holding that 18-to-20-yearolds are, like other subsets of the American public, presumptively among ‘the people’ to whom Second Amendment rights extend.”
- The case Lowy v. Daniel Defense is currently before the Fourth Circuit Court of Appeals. Plaintiffs allege that several firearm, accessory and ammo manufacturers’ pro-Second Amendment social media posts somehow caused a third party criminal to commit a horrific public shooting. Perhaps they’re gonna sue the Army next.

The Only Ones

- We reported last month that a Blanchard [OK] elementary school student fired a school resource officer’s gun while it was still in the officer’s holster as they were on the playground. Details of the investigation of the incident have emerged, and it seems that the McClain County Sheriff’s Office School Resource Deputy’s Safariland 6000 series holster did not adequately cover his Sig P320 service pistol’s trigger and trigger guard, allowing a finger to (deliberately) enter and pull the trigger. The fails here are that the deputy did not properly match his gun and holster, and that he was unaware that the kid was playing with it while he had it on.
- You’ve heard that anti-gun BATFE Director Steve Dettelbach is quitting this Saturday, Jan. 18, just in time for President-elect Trump not to fire him. He was given an 80% AR-15 lower receiver during his retirement ceremony, potentially violating federal and DC laws. You can’t make this stuff up.
- While responding to a domestic violence call on Wednesday evening, Glendale [AZ] police officers shot and killed a man in a park who was unrelated to the incident, but who allegedly made a furtive movement when police told him to show his hands.
- San Antonio Police Officer James Lopez was caught on camera shooting a man 15 times during a pursuit, after he confronted him about jaywalking across the street. But police say the man died from a self-inflicted gunshot to the head. It doesn’t look good, Barney.
- Baltimore County [MD] Cpl. Royce Ruby recklessly shot a 5-year-old boy and got qualified immunity. It’s an old case that may go to SCOTUS.

- Donald Trump Jr. and financier Omeed Malik are teaming up to take the online firearms retailer GrabAGun public. The New York Post reported the profitable company – valued at $150 million and which made $100 million last year – is poised to make its debut on the New York Stock Exchange. On January 6, 2025, GrabAGun entered into an agreement to merge with Colombier Acquisition Corp. II (NYSE: CLBR), a special purpose acquisition company. PublicSq, a company Malik previously took public, will provide payment processing technology for GrabAGun. PublicSq caters to consumers seeking businesses committed to values like “freedom,” “family” and “the Constitution.” I have bought several guns and some ammo off GrabAGun and have had positive experiences in most cases.
