Litigation

  • The US Seventh Circuit Court of Appeals erroneously ruled this week in United States v. Rush that short-barreled rifles can still be restricted under the National Firearms Act.
  • Fifth Circuit Gives Trump Opportunity to Act on Suppressors.
  • Firearms Policy Coalition has asked the US Supreme Court to hear its Worth v. Jacobson case, agreeing with the State of Minnesota that the Court should take up the State’s petition in order to affirm the victory and eliminate unconstitutional age-based bans across the country. The US Eighth Circuit Court of Appeals unanimously held that Minnesota’s age restriction prohibiting adults ages 18-20 from carrying firearms is unconstitutional, but federal courts of appeal have divided over the constitutionality of such laws, thus prompting the appeal to SCOTUS.
  • Judge David Fleisher, an elected Harris County (TX – Houston area) Criminal Court Judge, finds no probable cause to search 17-year-old carrying pistol.
  • A panel of the Oregon court of appeals found that Measure 114 – a gun control law approved by voters over two years ago – is valid under the Oregon constitution, reversing a lower court ruling from a state judge who had kept it on hold. The law requires people to undergo a criminal background check and complete a gun safety training course in order to obtain a permit to buy a firearm. It also bans magazines with a capacity of more than 10 rounds. In a separate federal case, a judge ruled Measure 114 was lawful under the Second Amendment of the US Constitution. The plaintiffs in that federal case, which include the Oregon Firearms Federation, have appealed the ruling to the 9th US Circuit Court of Appeals. You can be certain that the law is in fact unconstitutional.
  • The Massachusetts Supreme Court has ruled that the state can require out-of-state visitors to obtain a special permit for their lawfully owned firearms, but only if the state grants those permits using objective standards, saying “To be consistent with the Second Amendment, the Commonwealth’s nonresident firearm licensing scheme cannot vest an official with the discretion to deny a license to a qualified applicant. The defendant was charged under a firearm licensing scheme that did just that. This manner of firearm restriction is no longer permissible.” Actually it was never permissible, no matter what the courts say.

Legislation

  • Wyoming Governor Mark Gordon allowed Wyoming Bill 172, the “Wyoming Repeal Gun Free Zones Act,” to become law without his signature. He was opposed to the bill. The act repeals most of the areas where the legislature has allowed local political entities to infringe on rights protected by the Second Amendment. We note that there are no “zones” in the Constitution where the Bill of Rights is not valid.

  • Sunday night a University of Mississippi Medical Center nurse (identity redacted) employed on Fourth Floor North was violently attacked by a man armed with a gun in the parking lot on the way to her car as she left work. Fortunately she was not seriously injured, but she said even though the stranger asked for her purse, it didn’t seem to her that he wanted money. UMMC is a gun free zone and their cop shop is a Barney Fife force. That is the same hospital and same lot where my wife parked on days when we did not carpool to work. Thankfully we are both retired now.
