Litigation
More federal courts have expressed doubts about the legality of President Biden’s administrative pistol brace ban. U.S. District Judge Jane L. Boyle of the Northern District of Texas issued a preliminary injunction against the ATF’s ban on pistols equipped with stabilizing braces last week in the case Second Amendment Foundation v. ATF. Recognizing the injunction issued against the ban two days earlier by a three-judge panel of the Fifth Circuit Court of Appeals, Boyle said similar concerns over administrative procedure and Second Amendment rights were at issue in the case before her court. She limited her injunction to just the plaintiffs in the lawsuit. In addition to the above cases, Gun Owners of America/Gun Owners Foundation has won a similar injunction from Judge Drew B. Tipton in U.S. District Court for the Southern District of Texas, Victoria Division, also limited to the plaintiffs – GOA members and individuals employed directly by the State of Texas or its agencies. There are two additional cases in other circuits. The Firearms Regulatory Accountability Coalition is suing in the Sixth Circuit, and a group of private citizens is suing in the Eleventh Circuit.
In response, the FPC has restructured its membership policies.
Chief U.S. District Judge James E. Boasberg of Washington, D.C. rejected a challenge to the government’s ability to disarm defendants as part of their criminal sentences, one of the first decisions to uphold the constitutionality of a gun ban for people on probation for misdemeanors since the Supreme Court’s Bruen decision last year. Boasberg issued the ruling temporarily barring gun possession by Daniel Shaw, a Jan. 6, 2021, Capitol attack defendant who pleaded guilty last November to one count of parading, demonstrating or picketing. Funny, I thought parading, demonstrating and picketing were all First Amendment rights. Boasberg’s ruling said both sides argued the case too broadly, and that the question is not whether misdemeanor offenders can be permanently barred from possessing firearms under the constitution, but simply whether they can be while on probation. Boasberg found that Shaw was already on probation for driving under the influence with a minor child when he trespassed at the Capitol, and the firearms restriction would deter another future offense, facilitate his supervision and promote public safety, particularly since he received little prison time. That last part would seem to also fly in the face of Bruen‘s explicit prohibition of a means-end test.
U.S. District Judge Jill A. Otake of Hawaii imposed a permanent injunction on the law prohibiting Hawaiian citizens from carrying billy clubs as a condition of a settlement in Yukutake v. Shikada, which allows law-abiding Hawaiians to own and carry “cudgels, truncheons, police batons, collapsible batons, billy clubs, or nightsticks” for their protection. It also orders the state to pay $50,000 to cover the plaintiffs’ legal fees.
Also from Hawaii, in the case Santucci v. City and County of Honolulu, U.S. District Court Judge Derrick Watson made permanent a preliminary injunction he issued in November, which ruled that the Honolulu Police Department could not bar a U.S. Navy officer from registering firearms because he reported seeking counseling for feeling homesick and depressed on the registration form. The HPD can also no longer require an applicant for a firearm permit to provide written certification from a psychiatrist, psychologist or doctor. Hawaii requires a permit to purchase both handguns and long guns and the permitting process included release to local police of medical records that may disclose any mental-health issues. The injunction relates to an earlier version of the registration form that HPD has since changed.
The National Association for Gun Rights is suing the state of Massachusetts over their 1998 “assault weapons” ban which was expanded in 2016 and which bans the sale and possession of most semi-automatic firearms and standard capacity magazines.

Chief U.S. District Judge Scott Skavdahl of the United States District Court for the District of Wyoming: “corner crossing on foot in the checkerboard pattern of land ownership, without physically contacting private land and without causing damage to private property does not constitute an unlawful trespass.”
Legislation
Vermont Governor Phil Scott recently signed legislation banning “paramilitary” or Militia activity. The law prohibits a person from teaching, training, or demonstrating to anyone else the use, application, or making of a firearm, explosive, or incendiary device capable of causing injury or death that WILL BE used in or in furtherance of a civil disorder. It also bans a person from assembling with others for such training, instruction, or practice. Violators could face up to five years in prison, a $50,000 fine, or both. Of course that definition is based on future intent. And then there’s that little “A well regulated Militia, being necessary to the security of a free State” clause in the Second Amendment.

More on that cop who shot up the bathroom at the Massachusetts Catholic school: According to the police department statement, Detective Christopher Gaffney, an 11-year department veteran, started holstering his gun, and reported that as he did, his index finger was extended along the side of the barrel, which is consistent with his training, and that a secondary piece of equipment interfered with the holstering process, resulting in a single shot being discharged and striking the bathroom tile floor next to the officer’s foot.
Indianola, MS Police Sgt. Greg Capers responded to an 11-year-old boy’s 4 a.m. 911 call to his mother with a domestic situation, kicked the door in and then shot the boy when he responded to the officer’s call for everyone to come out with their hands up. The boy had reportedly made no menacing moves and had nothing in his hands but simply walked into his living room and was shot. The boy was hospitalized five days for a collapsed lung, lacerated liver and fractured ribs. Capers was suspended with pay. The boy and his family have filed a $5 million lawsuit against the city, the police chief and several officers in US District Court for the Northern District of Mississippi, claiming excessive force, negligence, reckless endangerment, and civil assault and battery, among other counts. No word on criminal charges in the case so far, but don’t expect any.
A grocery delivery driver is suing the Sylvania Township, OH, Police Department and two of its officers to the tune of $30 million for battery, assault, deprivation of rights and negligence after she was allegedly assaulted at gunpoint after being pulled over for expired tags in June 2022.

The Lululemon story shows how far out of tune company policy is with the real human experience out here. Nobody wants to have their life dictated by the common criminal or the common executive administration. Maybe we should put all of those types in one enclosed area and watch from a distance.
