  • Giffords.org has a page where they are asking for Fudd gun owners to sign up as a “Gun Owner for Harris-Walz.” As Firearms Policy Coalition noted on X: Surveys estimate that over 70 million Americans own guns, yet Giffords could only get 400 people to fill out an internet form with their name and email.

Litigation

  • US District Judge John L. Sinatra, Jr. of the Western District of New York has ruled that the state’s restriction against concealed carry on private property open to the public is unconstitutional. New York State’s “Vampire Law” turned private property open to the public into “gun free zones” unless the owner posted signs or gave express permission to carry a firearm on the property. The case is Christian v. James.
  • The US Supreme Court declined a request by Pennsylvania officials to review an appeals court decision striking down the state’s ban on gun carry for adults under 21 during declared states of emergency. Instead, the justices opted to grant, vacate, and remand (GVR) that decision back to the Third Circuit Court of Appeals to be re-examined with the Supreme Court’s most recent Second Amendment decision in mind, saying “The petition for a writ of certiorari is granted. The judgment is vacated, and the case is remanded to the United States Court of Appeals for the Third Circuit for further consideration in light of United States v. Rahimi.” The denial at least temporarily allows Pennsylvania to once again deny gun carry rights to 18-20-year-olds at the discretion of the state’s Governor. In Rahimi, the Court issued a narrow ruling that upheld the federal gun ban for unconvicted persons subject to court-issued domestic violence restraining orders. The majority in that case felt that although Rahimi had not been convicted, he met a standard of “dangerousness” that historically would have allowed him to be barred from possession of firearms. We are unable to see a correlation between that and any scenario wherein an entire group of young adults who have literally neither done nor been accused of any illicit behavior, suddenly becomes “dangerous” only because the governor unilaterally issued a state of emergency. Due process, anyone?
  • The US Second Circuit heard arguments Wednesday in two cases from gun rights groups challenging Connecticut’s effective ban on AR-15 rifles. The arguments seem to be over whether or not AR-15s should be considered “dangerous and unusual weapons,” a term that itself is a non-constitutional creation of the courts.
  • A Pennsylvania homeowner has filed a federal lawsuit against the Pennsylvania Fish and Boat Commission, challenging a state law that allows waterways conservation officers (WCOs) to enter private property without a warrant.

  • In a precedent-setting decision, a Florida appeals court ruled that the state’s “stand your ground” self-defense law can extend to situations where a person uses deadly force against an animal.
