The US District Court for the Southern District of Illinois declared provisions of the Protect Illinois Communities Act (PICA) which criminalize possession and require registration of so-called “assault weapons and “large-capacity magazines” unconstitutional under the Second Amendment. Illinois immediately appealed. The case is Harrel v. Raoul. We note that the argument that semiautomatic weapons are somehow protected by the Second Amendment, while fully automatic “military” weapons are not, is false.
(We reported a couple of weeks ago that the US Court of Appeals for The District of Columbia ruled in the case Hanson v. District of Columbia that DC’s ban on standard capacity magazines is constitutional. Numerous other similar cases are winding through the appeals courts. This would appear to set up a SCOTUS-worthy clash. But first watch the Maryland case Snope v. Brown, which is a gun ban already appealed and petitioned for SCOTUS cert consideration next month.)

We are long past the point that government officials who are adjudicated to have violated citizens’ rights should actually be criminally punished, instead of just using their victims’ money to defend their crimes. In other words, LOCK THE GOVERNMENT CRIMINALS UP.
Gun Owners of America (GOA) and Gun Owners Foundation (GOF), together with the Tennessee Firearms Association, filed a lawsuit in Shelby County, Tennessee against the City of Memphis‘ newly adopted gun control ordinances, which were passed by voters in direct opposition to the state’s robust preemption law.

The Sportsman’s Alliance of Maine and Gun Owners of Maine filed a lawsuit Tuesday that seeks to overturn the 72-hour gun sale waiting period law that Maine lawmakers passed last year. The waiting period violates people’s Second Amendment rights, according to the lawsuit filed in US District Court of Maine in Bangor.
Not being a lawyer, I suggest a logical solution. Anytime the government proposes to remove a citizen’s constitutional right (or life, liberty, property), it may only do so through a constitutional due process. It is the government’s – not the citizen’s – burden to provide proof of its case during the due process procedure. When there is a problem with the government’s own records, that is the government’s problem and not the citizen’s. When that problem sinks the government’s case, by default the citizen wins. Simple, but the government doesn’t like it, which is itself an extremely good reason to go that way.

Former Hinds County, MS, interim sheriff Marshand Crisler faces up to 10 years in prison after a federal jury in Jackson found him guilty of soliciting and accepting bribes from a man with previous felony convictions and a pending violent charge. Crisler was charged with soliciting and accepting $9,500 worth of bribes during his unsuccessful 2021 campaign for Hinds County sheriff in exchange for favors and GIVING THE MAN AMMUNITION HE CAN’T POSSESS AS A FELON.
A man who authorities said was upset over his divorce settlement rammed his car into a crowd of people exercising at a sports complex in southern China, killing 35 and severely injuring dozens of others. It must have been one of those evil black semi-fully automatic assault vehicles.
But, would-be gun buyers in the state of Washington have been unable to purchase defensive weapons for more than a week, after an issue with the state’s Secure Automated Firearms E-Check system run by the Washington State Patrol. According to the Second Amendment Foundation – which is threatening legal action, the system has been “disabled” for at least a week and a half, which means retailers are unable to complete the background check required to purchase a firearm. But the stabbings continue.
“It is thus in our best interest (particularly for those of us who go armed) to adopt a personal philosophy where any use of force, particularly lethal force, be reserved only for those times when it is absolutely necessary in order to prevent harm to our persons, or to our loved ones. In addition, we need to adopt of personal lifestyle that makes these kinds of circumstances/contacts unlikely.”
Mississippi deer: We have a report that Mississippi’s deer population may be at an all-time high and the Mississippi Department of Wildlife, Fisheries and Parks is asking hunters to help get the population under control by harvesting more deer. Well, if you want more deer killed, maybe you should rescind some of those dozens of new deer hunting regulations implemented over that past 2 or 3 decades. Legally shooting a deer in Mississippi is kind of like trying to figure out who is leading in the NASCAR points.
