Litigation
The US Supreme Court denied certiorari in Shew v. Malloy and Kampfer v. Cuomo, the cases that challenged gun bans in CT and NY, respectively, passed after the 2012 Newtown massacre. The 2nd US Circuit Court of Appeals previously upheld the laws prohibiting semiautomatic weapons and large capacity magazines in the two states, pretty much directly contradicting SCOTUS’ Heller decision.
This lets the bans stand, and is effective only in the 2nd Circuit. More than 95% of New Yorkers refused to register their guns, and more than 90% of Connecticut gun owners also refused.
Given the current makeup of the Court, this may be a good thing. Except, the leftist SCOTUS justices don’t want to admit these laws, which involve a “core” right, should be looked at with strict scrutiny, which requires them to be overturned. Except they’re not that honest.
Plaintiffs said “We fully intend to renew our challenge to Connecticut’s blatantly unconstitutional ban as soon as there are five Justices sitting on the Supreme Court committed to the proper understanding of the Second Amendment.”
Good luck with that.
The Pennsylvania Supreme Court unanimously barred enforcement of a preemption law designed to make it easier for organizations like the NRA to challenge cities’ firearms ordinances. The justices agreed with a lower court that packaging the measure into a bill on criminal penalties for theft of secondary metals — like wire or cable — violated a constitutional requirement that bills must be confined to one subject.
Legislation
The US Senate voted down four gun control amendments tacked onto a Department of Justice spending bill Monday evening. Two were introduced by Democrats (to let the attorney general deny firearms and explosives to any suspected terrorists, and to implement “universal” background checks — i.e., gun registration) and two by Republicans (to allow authorities to delay a gun sale to a terrorism suspect for three days or longer if a judge ruled during that time that there is probable cause to deny the firearm outright, and to increase funding for the government to run background checks without expanding them).
Every single Democrat, with the exception of Donnelly (D-IN) and Manchin (D-WV), voted against the proposal to delay sales to terrorism suspects — the very proposal Democrats said they wanted. Then they blamed the Republicans for failure of the bills.
You still need to stay on top of your senators to keep them from even thinking about it. More proposals to come.
Over in the US House, liberal representatives staged a sit-in on the House floor, in protest of gun-ban votes they weren’t allowed to cast against legislation that had already died in the Senate. That’s right — a liberal sit-in AGAINST civil rights. Because they are babies incapable of comprehending the Constitution or of leading anything. Remember the Andy Griffith episode about Opie’s buddy, the spoiled kid? And the woodshed solution? Well, here we are.

We’ve also learned that House Democrats used the staged sit-in as a basis to solicit campaign contributions.

Why does the political right not want to ban gun sales to those on the “No Fly” list (which is not the same as the “Terrorist Watch List”)?
Because: 8 ways you can end up on the no-fly list
- Being suspected to have been involved at some point in time of terrorist activities. Whatever that means, because no one seems to know.
- Travel to other countries. Since the State Department views certain countries as either “good” or “bad,” this can be pretty arbitrary. No State Dept. bureaucrat was held responsible for letting these people back in.
- Complaints from social justice warriors on social media. No really, that’s it.
- Have a name that sounds the same as someone on the No Fly List. Which is in no way arbitrary or against the rule of law.
- When the alphabet agencies call you out, you don’t play ball. As in, if you don’t snitch, you don’t fly. Or own a gun apparently.
- Because Bureaucracy. Typing errors can get you on the list. Try defending yourself to the machine that you, Mr. John Q. Smith from Anytown USA is not Mohammed Salafist.
- Bench warrants, too many parking tickets, whatever.
- Again, Social Media. Tweeting your displeasure in the Hillary/Bernie 2016 ticket can catch the eye of Mordor and keep you from flying.
Meanwhile, federal air marshals say they are putting innocent people on a “suspicious persons” watch list to meet their quota. Because we don’t have enough terrorists to meet the left’s needs, I suppose.
“Although the agency strongly denies any presence of a quota system, Las Vegas-based air marshals have produced documents that show their performance review is directly linked to producing SDRs.”

ISIS jihadists beheaded a four-year-old girl then forced her horrified mother to soak her hands in her dead daughter’s blood in the Daesh (ISIS) de-facto capital of Raqqa, in Syria.
Government transcripts recording events surrounding the Orlando massacre released to the public have reportedly been scrubbed of any reference to Islam, ISIS, etc.
It turns out the Orlando terrorist had stated his support for Hillary for president, because he thought she could defeat Trump.
In the past four months, ISIS has issued nine US kill lists, including the names and addresses of 3,600 New Yorkers, 15,000 Texans and 11 Tennessee county board members. Authorities say they’re random lists collected from information easily accessed online.
White House mouthpiece Josh Earnest said Republican senators who voted down some unconstitutional gun control bills this week are “cowards.” Earnest, who hides behind his boss and the armed Secret Service, and apparently has no ability or willingness to take care of himself, would seem to be the true coward here.
Third-term Hinds County, MS District Attorney Robert Shuler Smith, whose anti-gun and pro-criminal antics we have previously reported, was arrested and booked into jail by officers from the MS Attorney General’s Office and the Hinds County Sheriff’s Department this week after a joint investigation by the AG’s Office (with whom Smith has an ongoing public feud) and the FBI into allegations that Smith illegally advised or defended individuals charged with crimes.
DA Smith, AG Jim Hood, and Hinds Co. Sheriff Victor Mason are all elected Democrats.
Smith was charged with 6 misdemeanor counts (involving 2 criminal defendants) of violating Mississippi Code Section 97-11-3, which states that the attorney general or district attorney shall not “consult, advise, counsel or defend” a person charged with a crime or misdemeanor.
Apparently there is strong physical evidence in the form of illicit letters, emails, etc., allegedly from Smith. The affidavit alleges Smith tried to help a criminal get out of jail, visited him in jail without his attorney present, tried to use a grand jury to pressure a circuit judge to drop a case against a criminal defendant, and referred to at least one of the defendants as his client.
Smith was also charged with resisting arrest. Sources say more charges could follow.
If convicted, Smith could (the statute says “shall”) be removed as district attorney and prohibited from holding any other elected office or government position. Additionally, he faces fines of $500 per count, and could lose his license to practice law.
Smith issued a statement of denial and deflection through an unofficial group of left-wing supporters.

Worst US massacre?
It seems that Orlando was not the worst mass shooting in US history, contrary to lamestream media reports. A worse massacre happened on December 29, 1890, when US troops indiscriminately shot and killed more than 150 American men, women, and children, and wounded 51 more (4 men and 47 women and children, some of whom died later); some estimates placed the number of dead at 300. It is known as Wounded Knee. That massacre was the result of an unconstitutional attempt to disarm Native Americans (Lakota), perpetrated by the United States government.
Orlando was not even second. Try the Washita Massacre of peaceful Indians (mostly Cheyenne) in what is now Oklahoma in 1868 by General Custer. Estimates of civilian deaths range as high as 150, including women and children.
Undoubtedly there are others, perhaps worse. That would be a good history project.
Remember that the next time someone opines that the government is the only legitimate repository of “military grade” firearms.
The Only Ones
Federal prosecutors are investigating whether Jonathan Wienke, a Department of Homeland Security analyst with top-secret clearance was planning an attack at the agency’s Washington headquarters when he entered the building earlier this month with a gun, a knife, an infrared camera, pepper spray and handcuffs.
Investigators say they have probable cause to believe Wienke “was conspiring with another to commit workplace violence, and more particularly may have been conspiring or planning to commit violence against senior DHS officials in the building.”
Wienke was charged with carrying a pistol without a license and has been placed on administrative leave.
Well that’s a little different…
Virulently anti-gun US Rep. Charlie Rangel (D-NY), this week: “Law-abiding citizens just shouldn’t have to carry a gun. You’re not gonna push me in that direction,” he said, standing just five feet from a Capitol Police officer, who stood at his post by the House Speaker’s Lobby.
TheDC noted to Rangel he and other members of Congress are protected by armed members of the U.S. Capitol Police.
“Well that’s a little different. I think we deserve–I think we need to be protected down here.” Rangel laughingly insisted.
No sir, what you need is a prosecution for treason.

- Remington’s “second model” of its beleaguered R51 pistol is now ready to be shipped, but only to original R51 customers, until they are all made whole. The original customers’ replacement pistols will include a custom Pelican hard pistol case and two extra magazines.
- The R51 is a 9mm update of the original Remington Model 51, a .380/.32 ACP single stack pocket carry gun from the early 20th Century, designed by John D. Pedersen. The R51 was introduced in early 2014 and soon serious problems including out of battery firings began to appear, triggering a recall.
